MEMORANDO DE ENTENDIMENTO SOBRE CONSULTAS POLÍTICAS ENTRE O MINISTÉRIO DAS RELAÇÕES EXTERIORES DA REPÚBLICA FEDERATIVA DO BRASIL E O MINISTÉRIO DOS NEGÓCIOS ESTRANGEIROS DA REPÚBLICA DA ALBÂNIA

O Ministério das Relações Exteriores da República Federativa do Brasil

e

O Ministério dos Negócios Estrangeiros da República da Albânia (doravante denominados “Partes”),

Norteados pelos princípios do respeito à soberania, da igualdade e da não intervenção em assuntos domésticos, de acordo com a Carta das Nações Unidas;

Considerando os benefícios que traria, para ambas as Partes, o estabelecimento de consultas políticas e o intercâmbio de opiniões, em diversos níveis, sobre temas de relacionamento bilateral e sobre questões regionais e internacionais de interesse comum,

Chegaram ao seguinte entendimento:

Artigo I

As Partes organizarão, mediante acordo mútuo, reuniões regulares de consultas políticas sobre temas de sua competência, segundo suas respectivas legislações nacionais.

Artigo II

Os encontros serão realizados, alternadamente, em Tirana e Brasília. O nível das delegações, as datas e a agenda dos encontros serão estabelecidos por via diplomática.

Artigo III

As Partes poderão, mediante acordo mútuo, estabelecer grupos de trabalho ou grupos de peritos para o exame de questões específicas. Quando considerarem conveniente, as Partes poderão convidar representantes de outras agências governamentais, não governamentais, ou de terceiras partes, a participar dos referidos grupos.

Artigo IV

As Partes estimularão a cooperação entre seus respectivos representantes em organizações e fóruns internacionais.

Artigo V

Este Memorando de Entendimento poderá ser emendado ou complementado por acordo mútuo das Partes, mediante protocolos separados que entrarão em vigor segundo os mesmos requisitos deste Memorando de Entendimento. Esses Protocolos constituirão parte integrante do presente Memorando de Entendimento.

Artigo VI

1. Este Memorando de Entendimento entrará em vigor no momento de sua assinatura, e permanecerá em vigor por um período de 5 (cinco) anos, quando terá sua vigência automaticamente prorrogada por períodos adicionais de 1 (um) ano.

2. Qualquer das Partes poderá manifestar, a qualquer tempo, sua intenção de denunciar este Memorando de Entendimento, por via diplomática. A revogação terá eficácia 6 (seis) meses após a data da notificação.

Feito em Brasília, em 27 de outubro de 2011, em dois (2) exemplares originais, nas línguas portuguesa, albanesa e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalecerá o texto em inglês.

MEMORANDO DE ENTENDIMENTO ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O CONSELHO DE MINISTROS DA REPÚBLICA DA ALBÂNIA SOBRE COOPERAÇÃO ECONÔMICA

O Governo da República Federativa do Brasil

e

O Conselho de Ministros da República da Albânia

(doravante denominados “as Partes”),

Com o objetivo de estreitar e desenvolver as relações econômicas entre os dois países,

Chegaram ao seguinte entendimento:

Artigo 1º

1. As Partes promoverão o desenvolvimento da cooperação econômica em benefício mútuo, de acordo com as respectivas legislações nacionais.

2. A cooperação no âmbito do presente Memorando de Entendimento tem por objetivo:

a) utilizar o potencial econômico das Partes para estreitar as relações econômicas bilaterais; e

b) intensificar as relações econômicas bilaterais, especificamente nas esferas do comércio, do investimento e da inovação.

Artigo 2º

1. A Cooperação especificada no Artigo 1º deste Memorando de Entendimento será realizada como segue:

a) cooperação entre organizações econômicas das Partes;

b) lançamento e promoção de diferentes formas de compartilhamento de experiências nas esferas econômica e comercial, incluindo o intercâmbio de especialistas e de equipes técnicas e a organização de treinamentos; e

c) facilitação da participação em exibições e feiras, missões comerciais e outros eventos de promoção comercial organizados nos territórios das Partes.

2. A cooperação entre as Partes não estará limitada às formas especificadas neste Artigo e poderá ser também realizada de maneira diversa.

Artigo 3º

1. Os organismos competentes das Partes promoverão o estabelecimento e as atividades de escritórios de representação, de filiais e de subsidiárias de companhias de uma Parte na outra Parte.

2. O procedimento para o estabelecimento e a realização das atividades dos escritórios de representação, das filiais e das subsidiárias será determinado pela legislação da Parte em cujo território essa organização desenvolverá suas atividades.

Artigo 4º

Organismos competentes das Partes, respeitando a legislação de cada uma delas, intercambiarão informações relacionadas a:

a) legislação relativa a condições para a atividade econômica, investimentos, exigências técnicas e procedimentos de avaliação de conformidade, emissão de licenças, permissões, proteção dos direitos de propriedade intelectual e industrial e outras áreas de interesse comum; e

b) atividades com o objetivo de estreitar as relações entre companhias e associações empresariais das Partes, incluindo a organização de exibições internacionais, feiras e missões comerciais.

Artigo 5º

1. Este Memorando de Entendimento não compelirá qualquer das Partes a agir de forma contrária a ou inconsistente com suas obrigações internacionais ou com sua legislação doméstica.

2. Este Memorando de Entendimento não envolve qualquer transferência de fundos de uma Parte para a outra, nem qualquer atividade além das regulares de natureza diplomática e de promoção comercial, gravosas aos respectivos tesouros nacionais.

3. Este Memorando terá efeito na data da sua assinatura e permanecerá válido indefinidamente.

4. Este Memorando poderá ser emendado pelo consentimento das Partes por via diplomática.

5. Qualquer das Partes poderá, a qualquer tempo, notificar a outra, por via diplomática, da sua decisão de denunciar este Memorando. A denúncia terá efeito noventa (90) dias após a data da notificação.

6. Qualquer controvérsia relacionada à interpretação ou à implementação deste Memorando será solucionada por negociação direta entre as Partes.

MEMORANDO DE ENTENDIMENTO ENTRE O INSTITUTO RIO BRANCO DO MINISTÉRIO DAS RELAÇÕES EXTERIORES DA REPÚBLICA FEDERATIVA DO BRASIL E A ACADEMIA DIPLOMÁTICA DO MINISTÉRIO DOS NEGÓCIOS ESTRANGEIROS DA REPÚBLICA DA ALBÂNIA SOBRE COOPERAÇÃO MÚTUA EM TREINAMENTO DE DIPLOMATAS

O Instituto Rio Branco do Ministério das Relações Exteriores da República Federativa do Brasil

e

A Academia Diplomática da República da Albânia (doravante denominados “Partes”),

Reconhecendo o espírito de cooperação existente entre os dois países; e

Desejando promover estreita colaboração no treinamento de diplomatas,

Chegaram ao seguinte entendimento:

1. O objetivo deste Memorando de Entendimento é criar condições para que sejam mantidos contatos regulares e para que se promova cooperação entre as Partes.

2. As Partes cooperarão em matéria de intercâmbio de informação e experiências acerca de seus respectivos programas de estudo e pesquisa, cursos, seminários e demais atividades acadêmicas, educacionais e de treinamento.

3. As Partes promoverão contato e intercâmbio de estudantes, diplomatas, funcionários, professores, especialistas e pesquisadores.

4. As Partes estimularão o estudo e a pesquisa, bem como manterão intercâmbio de informações sobre publicações nacionais e internacionais, especialmente em áreas de interesse mútuo.

5. As Partes intercambiarão informações e visões relacionadas a tendências e avanços internacionais em matéria de formação, estudo e pesquisa em diplomacia, política externa, relações internacionais, direito internacional, relações econômicas internacionais, ciência política e outras áreas relevantes, bem como ferramentas relativas a ensino eletrônico.

6. As Partes poderão explorar possibilidades de outras formas de cooperação no âmbito das finalidades do presente Memorando.

7. As Partes decidirão, por via diplomática, as especificidades e a logística de cada projeto empreendido em conjunto. Para tal propósito, serão celebrados, se necessário, protocolos estabelecendo os termos e as condições dos intercâmbios propostos.

8. Este Memorando de Entendimento surtirá efeito na data de sua assinatura e permanecerá em aplicação por período de três anos, sendo automaticamente renovado, por período adicional de três anos, exceto se denunciado por uma das Partes, mediante comunicação escrita à outra, 90 dias antes de sua expiração. A denúncia deste Memorando não afetará projetos em execução.

9. O presente Memorando de Entendimento poderá ser modificado, a qualquer momento, por consentimento mútuo das Partes , por via diplomática

10. Qualquer controvérsia relativa à interpretação ou à aplicação dos dispositivos deste Memorando será resolvida de forma amigável pelas Partes, por via diplomática.

Assinado em Brasília, em 27 de outubro de 2011, em dois originais, nos idiomas português, albanês e inglês, sendo todos os textos igualmente válidos.

ACORDO ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O CONSELHO DE MINISTROS DA REPÚBLICA DA ALBÂNIA SOBRE A ISENÇÃO DE VISTOS

O Governo da República Federativa do Brasil

e

O Conselho de Ministros da República da Albânia (doravante denominados “Partes”),

Desejando fortalecer os laços de amizade e cooperação entre os dois países;

Reconhecendo a necessidade de resguardar o princípio da reciprocidade e de facilitar as viagens de seus nacionais nos territórios de ambos os países,

Acordam o seguinte:

Artigo 1

1. Os nacionais das Partes, portadores de passaportes nacionais válidos, estarão isentos de visto para entrar, transitar, permanecer e sair do território da outra Parte para fins de turismo e negócios, por um período máximo de noventa (90) dias a cada cento e oitenta (180) dias, contados da data da primeira entrada

2. O termo “fins de negócios”, mencionado neste artigo, significa participação em encontros de negócios, negociar contratos, discutir projetos, bem como realizar outras atividades que não caracterizem trabalho remunerado ou emprego no território da outra Parte.

3.Os nacionais de qualquer das Partes, portadores de passaportes nacionais válidos, devem obter os vistos apropriados segundo a legislação da outra Parte se pretendem permanecer no território da outra Parte por período superior a noventa (90) dias; ou se pretendem desempenhar atividades empregatícias ou remuneradas no território da outra Parte.

Artigo 2

Os nacionais mencionados neste Acordo podem entrar, transitar e sair do território da outra Parte através de qualquer ponto da fronteira aberto ao tráfego internacional de passageiros.

Artigo 3

1. Os nacionais das Partes respeitarão as leis e os regulamentos vigentes no território da outra Parte durante sua estada.

2. Toda modificação nas leis e regulamentos nacionais concernentes a entrada, saída, trânsito e estada de estrangeiros deverá ser comunicada à outra Parte com a maior brevidade possível, por via diplomática.

Artigo 4

As Partes readmitirão seus nacionais nos territórios de seus respectivos Estados sem formalidades ou despesas adicionais.

Artigo 5

Este Acordo não cerceia o direito de cada Parte de recusar a entrada ou abreviar a permanência de cidadãos da outra Parte considerados indesejáveis.

Artigo 6

1. As Partes intercambiarão, por via diplomática, exemplares de seus passaportes válidos, mencionados neste Acordo, no prazo máximo de trinta (30) dias após a data de assinatura deste Acordo.

2. Caso haja introdução de novos passaportes ou modificação dos existentes, as Partes intercambiarão, por via diplomática, exemplares de seus novos passaportes, acompanhados de informação pormenorizada sobre suas características e utilização, com a antecedência mínima de trinta (30) dias antes de entrarem em circulação.

Artigo 7

1. Por razões de segurança pública, ordem pública ou saúde pública, qualquer das Partes poderá suspender a aplicação deste Acordo total ou parcialmente.

2. A suspensão e sua posterior revogação serão notificadas à outra Parte por via diplomática, com a maior brevidade possível.

Artigo 8

1. Este Acordo será válido por tempo indeterminado e entrará em vigor trinta (30) dias a partir da data da segunda nota diplomática em que uma Parte informa à outra do cumprimento dos respectivos requisitos legais internos para sua entrada em vigor.

2. Este Acordo poderá ser emendado mediante consentimento mútuo entre as Partes, expresso formalmente por via diplomática. Emendas entrarão em vigor nos termos do parágrafo 1 deste artigo.

3. Qualquer das Partes poderá denunciar, a qualquer tempo, o presente Acordo por via diplomática. A denúncia terá efeito noventa (90) dias após a data de recebimento da notificação da outra Parte.

4 – AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE COUNCIL OF MINISTERS OF THE REPUBLIC OF ALBANIA ON EXEMPTION OF VISA REQUIREMENTS

MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF EXTERNAL RELATIONS OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF ALBANIA ON POLITICAL CONSULTATIONS

The Ministry of External Relations of the Federative Republic of Brazil

and

The Ministry of Foreign Affairs of the Republic of Albania (hereinafter referred to as "Parties"),

Guided by the principles of respect for sovereignty, equality and non-interference in internal affairs, in accordance with the Charter of the United Nations;

Considering the benefits for both Parties of the establishment of political consultations and of the exchange of opinions, on different levels, on subjects of bilateral relations and regional and international issues of common interest,

Have reached the following understanding:

Article I

The Parties will organize, upon mutual agreement, regular meetings for political consultations on topics that fall within their scope according to their national legislation.

Article II

The meetings will take place alternately in Tirana and in Brasilia. The level of the delegations, the dates and the agenda of the meetings will be established through diplomatic channels.

Article III

The Parties may, upon mutual agreement, establish working groups or groups of experts for the exam of specific matters. When deemed convenient, the Parties may invite representatives from other governmental and non-governmental bodies or third parties to take part in such groups.

Article IV

The Parties will stimulate the cooperation between their respective representatives in the context of international organizations and forums.

Article V

This Memorandum of Understanding may be amended or supplemented by mutual agreement of the Parties, which shall be arranged as separate Protocols and shall enter into force subject to the same requirements as this Memorandum of Understanding. These Protocols constitute integral parts of the present Memorandum of Understanding.

Article VI

1. This Memorandum of Understanding shall come into force upon its signature and shall remain in force for a term of 5 (five) years, when it shall be automatically extended for further terms of 1 (one) year.

2. Any of the Parties may express, at any time, its intention to terminate this Memorandum of Understanding, through diplomatic channels. Termination shall be effective 6 (six) months after the date of notification.

Done in Brasilia, on 27th October, 2011, in two originals, each in the Portuguese, Albanian and English languages, all texts being equally authentic. In case of divergence of interpretation of this Memorandum of Understanding, the English text shall prevail.

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE COUNCIL OF MINISTERS OF THE REPUBLIC OF ALBANIA ON ECONOMIC COOPERATION

The Government of the Federative Republic of Brazil

and

The Council of Ministers of the Republic of Albania (hereinafter referred to as the "Parties"),

Aiming to strengthen and develop economic relations between their countries,

Have agreed as follows:

Article 1

1. The Parties will promote the development of mutually beneficial economic cooperation in accordance with their respective legislation.

2. Cooperation implemented under the present Memorandum of Understanding aims:

a) to use the economic potential of the Parties to strengthen bilateral economic relations; and

b) to intensify bilateral economic relations, namely in the trade, investment and innovation spheres.

Article 2

1. Cooperation specified in Article 1 of this Memorandum of Understanding will be implemented as follows:

a) cooperation between economic organizations of the Parties;

b) launch and promotion of different forms of experience sharing in the economic and trade spheres, including exchange of experts and technical staff and organization of trainings; and

c) facilitation of participation in exhibitions and fairs, business missions and other trade promotion events organized on the territory of the Parties.

2. Cooperation between the Parties will not be limited to the forms specified in this Article and may also be implemented in other ways.

Article 3

1. Relevant bodies of the Parties will promote the establishment and activity of representative offices, branches and subsidiaries of companies from one Party in the other Party.

2. The procedure for the establishment and implementation of activities of representative offices, branches and subsidiaries will be determined by the legislation of the Party on whose territory this organization carries out its activities.

Article 4

1. Relevant bodies of the Parties will, in accordance with the legislation of each Party, exchange information related to:

a) legislation regarding conditions for economic activity, investments, technical requirements and conformity assessment procedures, issuance of licenses, permits, protection of industrial and intellectual property rights and other areas of common interest; and

b) activities aimed at strengthening relations between companies and business associations of the Parties, including organization of international exhibitions, fairs and business missions.

Article 5

1. This Memorandum of Understanding will not lead either Party to take any action that is contrary to, or inconsistent with, its international obligations or its domestic legislation.

2. This Memorandum of Understanding does not involve any transfer of funds from one of the Parties to the other or any other activity that may represent a burden to their national treasuries beyond regular diplomatic and trade promotion activities.

3. This Memorandum will come into effect on the date of its signing and will remain valid indefinitely.

4. This Memorandum may be amended by mutual consent of the Parties through diplomatic channels.

5. Either Party may, at any time, notify the other, through diplomatic channels, of its decision to terminate this Memorandum. Termination will be effective ninety (90) days after the date of the notification.

6. Any dispute relating to the interpretation or implementation of this Memorandum will be settled through direct negotiation between the Parties.

Done at Brasilia, on 27th October 2011, in duplicate, in Portuguese, Albanian and English, all texts being equally valid. In case of divergence of interpretation, the English text will prevail.

MEMORANDUM OF UNDERSTANDING BETWEEN THE RIO BRANCO INSTITUTE OF THE MINISTRY OF EXTERNAL RELATIONS OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE DIPLOMATIC ACADEMY OF THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF ALBANIA ON MUTUAL COOPERATION ON TRAINING OF DIPLOMATS

The Rio Branco Institute of the Ministry of External Relations of the Federative Republic of Brazil

and

The Diplomatic Academy of the Republic of Albania (hereinafter referred to as “Parties”);

Recognising the spirit of cooperation that exists between Brazil and Albania, and

Willing to promote closer collaboration on training of diplomats;

Have agreed to the following:

1. The objective of this Memorandum of Understanding (MOU) is to create conditions for maintaining regular contacts and promoting cooperation between the Parties.

2. The Parties will cooperate on exchange of information and experiences concerning their respective programmes of study and research, various courses, seminars and other academic, educational and training activities.

3. The Parties will promote contact and exchange of trainees, students, experts and researchers.

4. The Parties will encourage the study and research, as well as exchange of information on national and international publications, especially in areas of mutual interest.

5. The Parties will exchange information and views related to international trends and advances in training, study and research in diplomacy, foreign policy, international relations, international law, foreign economic relations, political science and other relevant areas, as well as tools related to e-learning.

6. The Parties may explore the possibilities of other forms of cooperation under the scope of objectives of this memorandum.

7. The Parties will decide, through the pertinent diplomatic channels, the specifics and logistics of every project they jointly undertake. For this purpose, protocols laying down the terms and conditions of the proposed exchanges will be concluded, if necessary.

8. This Memorandum will come into effect on the date of its signature and will continue to have effect for a period of three years. Thereafter, it may automatically be renewed for equal periods, unless terminated by any of the Parties by giving a written notice of ninety (90) days to the other Party prior to the date of termination of the Memorandum. The termination of this Memorandum will not affect ongoing projects.

9. This Memorandum of Understanding may be amended, at any time, by mutual consent of the Parties, through diplomatic channels.

10. Any dispute related to the interpretation of this Memorandum will be settled amicably by the Parties through diplomatic channels.

AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE COUNCIL OF MINISTERS OF THE REPUBLIC OF ALBANIA ON EXEMPTION OF VISA REQUIREMENTS

The Government of the Federative Republic of Brazil

and

The Council of Ministers of the Republic of Albania (hereinafter referred to as the “Parties”),

Desiring to strengthen the bonds of friendship and co-operation between the two countries;

Recognizing the need to safeguard the principle of reciprocity and to facilitate travels into each others territory by nationals of both countries,

Have agreed as follows:

Article 1

1. Nationals of either Party, holders of a valid national passports, shall be exempt from visa requirements to enter, leave, transit through and stay in the territory of the State of the other Party for purposes of tourism and business for a period not exceeding ninety (90) days per one hundred and eighty (180) days, counted from the first entry.

2. The business purposes mentioned in this article shall mean attending business meetings, negotiating contracts, discussing projects, and other activities that do not characterize paid work or employment in the territory of the other Party.

3. Nationals of either Party, holders of a valid national passport, must obtain the appropriate visa according to the legislation of the other Party if they intend to stay in the territory of the other Party for a period exceeding ninety (90) days; or to hold any employment or paid work in the territory of the other party.

Article 2

Nationals mentioned in this Agreement may enter, transit through and leave the territory of the other Party at all border-crossing points open to international passenger traffic.

Article 3

1. Nationals of either Party shall comply with the laws and regulations in force in the territory of the other Party, during their stay.

2. The Parties shall, as soon as possible, mutually inform each other through diplomatic channels of any change in their respective laws and regulations concerning entry, transit, stay and departure of foreigners.

Article 4

The Parties shall readmit their nationals into the territories of their respective States without any additional formalities or expenses.

Article 5

This Agreement does not curtail the right of either Party to deny entry or to shorten the stay of citizens of the other Party considered undesirable.

Article 6

1. The Parties shall exchange, through diplomatic channels, specimens of their valid passports, mentioned in this Agreement, no later than thirty (30) days after the date of signature of this Agreement.

2. In case of introduction of new passports or modification of the existing ones, the Parties shall convey to each other, through diplomatic channels, specimens of these passports, accompanied by detailed information on their specifications and applicability, not later than thirty (30) days prior to its application.

Article 7

1. For reasons of security, public order or public health, either Party may suspend the application of this Agreement in whole or in part.

2. The suspension and its subsequent revocation shall be notified to the other Party through diplomatic channels at the earliest possible time.

Article 8

1. This Agreement shall be valid for an indefinite period and shall enter into force thirty (30) days from the date of the second diplomatic note in which the Parties inform each other that the national legal requirements for entry into force of this Agreement have been met.

2. This Agreement may be amended by mutual consent between the Parties, formally expressed through diplomatic channels. Amendments shall enter into force in accordance with paragraph 1 of this article.

3. Each of the Parties may, at any time, denounce this Agreement through diplomatic channels. The denunciation shall be effective ninety (90) days after the date of the notification.

Done in Brasilia, on 27th October, 2011, in two original copies, in the Portuguese, Albanian and English languages, all of them being equally authentic. In case of any divergence of interpretation, the English version shall prevail.
